Siempre colaborando con la decisión democrática sobre el plebiscito sobre la modificación del Artículo 11 de la Constitución  de la República.-

Próximamente se someterá a plebiscito para que TODOS los ciudadanos resolvamos sobre los llamados Allanamientos Nocturnos. Cabildo Abierto ha acompañado la iniciativa ya que el Partido Nacional desde el Ministerio del Interior lo ha requerido y lejos está en nuestra intención poner obstáculos a su gestión; Pero eso sí! se solicitaron algunas cuestiones para el caso que saliera aprobada la iniciativa como lo son: la presencia del Juez al momento de ejecutarse el procedimiento  para dar garantías a la fuerza pública,  a los terceros circundantes y a las mismas personas intervenidas. Ademas de la adquisición de los  equipo técnico y tecnológicos para contribuir al cumplimiento de la misión con la mayor eficacia y garantías vitales, para todas las 19  Jefaturas y Unidades Especializadas Finalmente se solicita que se promueva un  entrenamiento específico en la materia.

Está es una operación policial que puede llegar a ser muy compleja; por lo tanto es bueno precisar algunas cuestiones, como las siguientes.

Definición de Operaciones Policiales:

 Son el conjunto de acciones profesionales, tendientes al cumplimiento de la misión con el máximo de eficacia, el mínimo de riesgo, con economía de recursos humanos y materiales.

Análisis muy breve precisando cada aspecto de la definición:

Conjunto de acciones profesionales, léase, solo los policías profesionales las pueden realizar.

– En el procedimiento en cuestión pueden participar varias unidades policiales con diferentes roles y especialidades lo que puede derivar en que el tiempo de mantenimiento del área de operaciones se dilate por 2 o más horas, y por ende complejizar el entorno y ampliar el riesgo de efectos colaterales como pedreas disturbios, etc.

– Las misiones de pueden se deducidas o requeridas a iniciativa de la policía, u ordenada por la justicia.

– El máximo de eficacia refiere a qué se persigue el éxito, en este caso lograr detenciones de autores de delitos, medios de prueba y otros fines .

– Toda operación policial lleva implícito riesgos, como lo son de vida obviamente, pero además de integridad física, penal no por dolo evidentemente,  sino por ultra intencionalidad, así como  culposa o a título de dolo eventual, y finalmente el riesgo administrativo materializado en sumarios.

– Cuando hablamos de economía , el concepto refiere a qué la información previa, vigilancia, preparación y planificación debe llevar a realizarse con la cantidad de personal y medios requeridos ni de más ni de menos.

Hechas estás breves precisiones, cuando Cabildo Abierto advierte sobre algunas condicionantes  solo persigue el bien de todos ciudadanos que estén involucrados según sus roles o intereses en el procedimiento. Por lo tanto a continuación dejaremos planteadas algunas preguntas, sobre todo para quienes deban elaborar los ajustes legales y/o  de otro tipo, así como para facilitar la decisión por parte del soberano:

1- Normalmente la determinación de la forma apropiada para ejecutar un allanamiento la realiza la policía a través  de decisiones del mando. A modo de ejemplo; si  el método será  si  presenta la autoridad ante el allanado y se le  da aviso informándole sobre la orden judicial y se ejecuta,  o de otra forma se  irrumpe coordinada y  planificadamente mediante un ingreso sorpresivo a la finca. Ahora bien, de noche podría ser diferente por obvias razones, la pregunta es no será conveniente que el Código del Proceso Penal establezca  que el juez asuma la responsabilidad y  cuando libre la orden deba especificar la forma de realizarse?

2) No será conveniente explicar claramente que de aprobarse los allanamientos nocturnos no se restringirán solo al Narcotráfico, sino a cualquier delito?

3) No será preciso que se reglamente si el procedimiento será una medida excepcional ajustada a determinadas situaciones delictivas y no quede librado a la libre aplicación en cualquier delito?

4) Se deberá crear una sede por Departamento disponible por departamento o regiones para concurrir de noche a este tipo de procedimientos de manera de brindar  garantías a todos , así como  para decidir in situ sobre  situaciones imprevistas, y de esta forma liberar y amparar  al Oficial de Policía a cargo de tales decisiones, procurando evitar un mal mayor?

5) Sería conveniente prever legalmente que la opinión profesional policial prime sobre la iniciativa  judicial al momento que el Juez, bajo está óptica  otorgue o no la orden?

6) Sería conveniente que el criterio imperante para librar una orden de allanamiento nocturno, considere realmente la ecuación del riesgo emergente en balance con el beneficio de reprimir un delito determinado, manejando otras opciones de actuación?

7) Se considera el hecho que con profesionalismo actualmente se realizan múltiples allanamientos exitosos, reduciendo los riesgos simplemente porque se puede ver y actuar con mayor seguridad ante un entorno hostil y que de noche esa posibilidad disminuye la acción de seguridad y defensa que por ende aumenta el riesgo de vida e integridad física para los actuantes?

8) Se es consciente que los riesgos aumentan todavía más a raíz que con este nuevo instrumento legal los criminales tomarán medidas de protección más activas contra las fuerzas operativas? Se está dispuesto a generar esta escalada en los eventuales enfrentamientos?

9)  La fuerza pública operará a pesar del riesgo aumentado si se ordena judicialmente. Pero se está dispuesto a dar ese paso siendo advertidos de esa posibilidad de mayor riesgo para todos?

10) Se es consciente que hay lugares en los cuales las construcciones no ofrecen seguridad para terceros inocentes si hay que repeler agresiones armadas, sea de donde sean  el origen de los disparos?

11) Se tendrá en cuenta que  de noche no se puede percibir de dónde provienen las eventuales agresiones con piedras, ni su trayectoria de aproximación hacia las personas actuantes y circundantes?

12) En la misma dirección que lo anterior , los disparos no del lugar objetivo , sino del entorno podrían no verse desde donde provienen  por el eco y nocturnidad dificultando la defensa y aunque se vea el fogonazo podría no percibirse ni la cantidad de agresores ni los campos de tiro, por lo tanto el delito a dolo eventual por lesiones a terceros estaría más latente que en otras circunstancias,se considerara esto?

Estás son solo algunas  preguntas, podrían surgir otras en pro y en contra,  pero todos debemos tomar conciencia y asumir los riesgos de nuestra decisión en el próximo acto plebiscitario.
