Artículo 1°

Modificase el artículo 52 de la Constitución de la República, el que quedará redactado en la siguiente forma:

Artículo 52.

Prohíbese la usura. Es de orden público la ley que señale límite máximo al interés de las obligaciones, la cual deberá ser aprobada con el voto de los dos tercios del total de componentes de cada una de las Cámaras.

La ley determinará el interés máximo permitido por todo concepto, incluido tasas de interés compensatorio y moratorio, comisiones, reajustes y cualquier otro gasto adicional. Ello se aplicará a todo tipo de obligaciones, incluidas las correspondientes al pago de facilidades o infracciones exigibles por el Estado, Entes Autónomos, Servicios Descentralizados, Gobiernos Departamentales, personas públicas de derecho privado y organismos paraestatales.

La ley no podrá delegar a ninguna autoridad la determinación del interés máximo referido anteriormente.

La ley determinará la pena a aplicarse a los contraventores.

Nadie podrá ser privado de su libertad por deudas.

Artículo 2°

Agregase a la Constitución de la República, a continuación de la Disposición Transitoria y Especial Z»), incorporada en ocasión de la ratificación plebiscitaria del día 31 de octubre de 2004, las siguientes Disposiciones Transitorias:

Z bis) Con la entrada en vigencia de la presente reforma constitucional y mientras no entre en vigencia una nueva ley de acuerdo con lo previsto en el artículo 52, fijase el interés máximo por todo concepto en una Tasa Efectiva Anual del 30 % (treinta por ciento) sobre los montos convertidos a Unidades Indexadas.

Z ter) Todas las deudas contraídas antes del 18 de julio de 2023, ya sea en moneda nacional, en moneda extranjera o en unidades reajustables, podrán ser canceladas por el deudor mediante el pago del monto inicialmente convenido, convertido a Unidades Indexadas al valor de la fecha de otorgamiento del contrato originario, en las siguientes condiciones: al monto resultante se le aplicará una Tasa Efectiva Anual del 4% (cuatro  por  ciento)  por  concepto  de  intereses,  multas,  moras,  recargos  y  cualquier  otro  tipo  de  gastos.  A dicho monto se le descontarán los pagos ya efectuados por el deudor por todo concepto, convertidos a Unidades Indexadas.

Esta disposición comprende a cualquier persona que tenga un total de adeudos por un monto originario no superior a UI 200.000 (doscientas mil unidades indexadas), contraído por personas físicas, o por las sociedades personales o sociedades agrarias en que la totalidad de las cuotas sociales pertenezcan a personas físicas, siempre que sean éstas sus beneficiarios finales.

La presente reforma constitucional entrará en vigencia el 1° de enero de 2025
